Lee arrived at the JJB Stadium on 29th July 2008 for a fee of £3.500.000 from Premiership rivals Middlesbrough. He signed a three-year deal, making his first appearance fro Latics a day later in a pre season friendly agaionst Barnsley at Oakwell, a game Latics won 6-0. He made his Latics Premier League debut on the opening day of the 2008/09 season against West Ham United at Upton Park on 16th August 2008, a game that resulted in a 2-1 defeat.
As at the end of season 2008/09 his Latics career consisted of 33 Premier League games during which he netted once. On 12th July 2009, just two days before the start of a new Premiership season, Lee signed for Sunderland for a fee of £6.000.000 as former Latics manager Steve Bruce finally got his man after chasing him since he left for the Stadium of Light in May 2009.
